A BILL to amend and reenact section nineteen, article two,
chapter sixty of the code of West Virginia, one thousand
nine hundred thirty-one, as amended, relating to permitting
the alcohol beverage control commissioner to hire counsel of
his or her choosing.
Be it enacted by the Legislature of West Virginia:
That section nineteen, article two, chapter sixty of the
code of West Virginia, one thousand nine hundred thirty-one, as
amended, be amended and reenacted to read as follows:
ARTICLE 2. ALCOHOL BEVERAGE CONTROL COMMISSIONER.
§60-2-19. Legal services.
The attorney general and the prosecuting attorneys of the
several counties shall render to the commission, without additional compensation, such legal services as it may require of
them in the discharge of its duties under the provisions of this
chapter if so requested by the commissioner. The commissioner,
however, may hire legal counsel and pay for the legal counsel
from the commissioner's operating fund provided in section
eighteen, article three of this chapter, or from any other source
of funding that may become available for that purpose.
NOTE: The purpose of this bill is to permit the ABCC to
hire its own legal counsel.
